Maryland 1031 Exchange Guide for Investment Property

Planning a 1031 exchange in Maryland? A qualifying like-kind exchange may defer recognition of gain when moving from one investment property to another. Plan the tax structure and replacement-property search together before your sale closes.

What property can qualify?

Section 1031 generally applies to real property held for business or investment and exchanged for like-kind real property held for those purposes. A property used solely as your personal residence does not qualify. Review the IRS overview with your tax adviser.

Watch the deadlines

In a deferred exchange, identify replacement property within 45 days after transferring the relinquished property. Receive it by the earlier of 180 days or your tax-return due date, including extensions. These periods run from the same transfer date. See the Form 8824 instructions.

Arrange the exchange first

Receiving or controlling sale proceeds can jeopardize deferral. A qualified intermediary is one recognized way to structure the handling of proceeds. Consult your adviser and intermediary before closing. See the IRS exchange FAQ.

Understand the tax result

Deferral is not a promise of permanent tax elimination. Cash, non-like-kind property and debt changes may affect recognized gain. Ask your tax adviser to calculate the result and address reporting, including Form 8824. Complex ownership or mixed-use situations require individual review.
